Vulnerable pensioners’ expensive Wills battle demonstrates why solicitors are the best option

The alarming tale of two of society’s weakest and most vulnerable people becoming embroiled in a battle with a Will writing firm demonstrates why solicitors are far and away the safest option for one of life’s most important documents.

The story has made the media sit up and take note and involves a housebound Bristol couple, Muriel and Jim Sutton, aged 87 and 90 years old. Mrs Sutton alerted the police after she was charged £6,000 by will writers, and claims the company’s representative also offered to run errands for the couple, such as doing their shopping.

It is a woeful tale and, whilst the Will writing firm deny any wrong-doing, we at Pindoria Solicitors feely very uncomfortable about how this defenceless couple found themselves in such a situation. Mrs Sutton has accused the firm of taking the money without her knowledge, whilst the company say they have signed paperwork showing the transaction is above board.

The report in the couple’s local newspaper said a representative from the will writers visited the couple in November 2015 and Mrs Sutton said they discussed the prospect of drawing up a new will and trust fund for their son who is autistic. The couple believe they never agreed or signed anything, but were shocked to discover two payments of £3,000 each had been taken out of her account by the company later that month.

It is all very unsavoury with the founder of the will writing company saying the couple had agreed and signed paperwork and had 14 days to cancel. Sadly though, the public can be at the mercy of hard sell tactics like this, but we believe good law firms need to speak up because the weaker members of society need protecting.

Whilst the Government has in recent years failed to make Will-writing a regulated activity, the simple fact is a solicitor is a qualified guardian of the law who has an unrivalled regulatory and compensation system to ensure the public is protected. We hope the situation for this unfortunate couple is remedied and just as importantly those who do not have the right form of legal protection and Wills in place do so as soon as possible.
