The formal process of divorce is started by the issue of a Divorce Petition. Under the current law in England and Wales there is just one ground upon which you can base your divorce; "that the marriage has broken down irretrievably".
The Petition must rely on one of the following "facts", to prove the irretrievable breakdown of your marriage:
In the majority of cases the divorce will be undefended and can, in uncomplicated cases, take 3 - 4 months from the date that the petition is filed until the pronouncement of the decree nisi. The Petitioner then has to wait a minimum of 6 weeks before he or she can apply for the decree absolute, which formally dissolves the marriage.
