Domestic Violence Victims to Benefit from Government Decision
A government decision to remove the time limit for evidence that will make it easier for domestic violence victims to qualify for legal aid has been welcomed by the legal profession.
Domestic violence in London and everywhere else in the UK is something, which is such a difficult issue to solve that we at Pindoria Solicitors are pleased that this move will help many suffering the physical and mental scars of this dark side of family law.
After reviewing current evidence arrangements for accessing legal aid in private family cases, the current five-year time limit will be removed completely the Ministry of Justice has confirmed.
Evidence that can be accepted will also be broadened. In future, the ministry says evidence will be accepted from domestic violence support organisations, which helps overcome many difficulties faced by victims gathering evidence.
The simple truth is that legal aid is a lifeline for those victims of abuse and often the only way someone can bring their case before the legal system.
The current rules had been very restrictive failing to assist a large number of victims. But hopefully now those seeking help, the vast majority being women can begin to take the path to justice.
Here at Pindoria Solicitors we can say unequivocally that those who have previously experienced or are currently experiencing some form of violence from their partner come from all walks of life.
The best advice we can give is to act speedily to make sure you and your family are safe and please pick up the phone and speak to a legal expert who can help in such matters.
Injunction orders can be sought to protect those feeling vulnerable and also it saves time if proceedings are instituted by the law, such as through issuing harassment proceedings.
Also remember domestic violence may not be physical. It’s a complex area and our advice even applies to examples where a person or their family might be dependent on the person carrying out the abuse in terms of financial help.
Having some of London’s best family law experts at the firm, we are acutely aware of the many differing scenarios, but please note that even if there is an issue of finance no victim of abuse should feel the need to stay in a hostile and threatening environment.
We and all good legal experts are here to help and just a phone call away from putting many people’s minds at rest.
